Terms and Conditions

The “not so small” print.

It is important that you are absolutely happy with, and fully understand, everything written below before joining us. As a product of today’s litigious society we have to produce a big legal document to make sure that you fully understand what you are letting yourselves in for.

All applications are made to “Gap Year Sport Limited (trading as Global Medical Projects)”, herein after referred to as “GMP, We or Us”. You are referred to as “The Participant or you”.

All persons applying are bound by the conditions of contract. By signing the application form you are indicating your wish to join the specified project subject to the following terms and conditions.

Application process

The Participant is required to complete the application form and submit it together with a deposit of £195 to secure your placement. This is non-refundable unless GMP is unable to offer The Participant a place or The Participant cancels within 7 days, otherwise the sum will form part payment of the full cost.

The Participant accepts that written information supplied is provided in good faith and based on the knowledge and information available prior to publication of the written material and sometimes months prior to the date of departure. GMP will confirm acceptance and confirm your booking on a project within 7 days unless there are any aspects of your application that will require further investigation (if The Participant is not accepted for your desired project then GMP will offer The Participant a possible alternative or immediately refund the deposit that The Participant has paid).

The final balance of the project is then due 3 months before the intended departure date. Should this not be received GMP reserves the right to regard the booking as cancelled by The Participant.

Overseas conditions

The Participant’s acceptance onto a project is on the understanding that you realise that living and working lesser economically developed countries can at times be uncomfortable. The Participant accepts that services and facilities that they are used to at home may not be available overseas. Running water, electricity and other home comforts cannot be guaranteed and where available will often fail.

GMP will endeavour to ensure that your living accommodation is of a reasonable condition by local standards, and The Participant accepts that it is impossible for GMP to guarantee this accommodation will be up to the standards you are used to at home.

GMP asks The Participant to approach their time overseas with an open mind and good humour.

The Project

Once a booking has been confirmed, GMP guarantees not to surcharge on the price of the project. However, such guarantee does not cover visa, airfare, United Kingdom or foreign taxes or local operator costs which are beyond the control of GMP.

GMP reserves the right to make alterations to a project without notice.

The decision of the Project Leader will be final on all matters relating to the organisation, progress, safety, and well-being of the project, and the Participant must comply with all reasonable requests of the Project Leader.

A booking is accepted on the strict understanding by the Participant that the laws, customs, foreign exchange and drug regulations of all countries visited will be fully complied with. A Participant found violating such laws and regulations or otherwise interfering with the well-being of the group or project may be required by the Expedition Leader to leave the trip without recourse.

The Participant agrees to abide by the terms and conditions of all carriers concerned with the project. All travel and other arrangements are made by GMP as agent for the Participant only and on the express condition that GMP is not liable for the default or negligence or for any loss, damage or injury, or any breach of contract caused by any person or company with whom such arrangements are made.

Liability

GMP will not accept any responsibility for any illness, accident or loss, weather conditions, fire, civil or military disturbance, criminal activity, industrial action, mechanical breakdown, quarantine, border closures, government intervention or force majeure. Although such circumstances are beyond the control of GMP, We shall make every effort to provide prompt assistance if you are in difficulty. Should it become necessary to abandon a project because of such an event GMP will be entitled to retain such monies received necessary to cover costs incurred. We exclude any liability for all representations other than fraudulent.

Travel

We cannot accept liability for the performance of services provided by airlines. We hold no responsibility for flights that you arrange.

Participant Health

The Participant is advised that in the countries where we operate there is no free health service. We cannot be responsible for your personal safety and health.

The Participant must ensure that you are medically fit and able to embark on their chosen project. The Participant agrees to disclose any significant previous or pre-existing medical conditions. Previous or pre-existing medications may not result in The Participant being denied a place but We reserve the right at any time to require The Participant to produce a Doctor’s certificate of fitness to participate in the project.

The Participant must consult their GP or health centre when seeking up-to-date advice on vaccinations and on which course of anti-malarial tablets you should be taking.

GMP will suggest advice on health requirements for the country the Participant is travelling to, but GMP accepts no liability for any inaccuracies in the advice suggested. The Participant should seek proper and up to date advice from their GP or suitably qualified medical practitioner about the precautions and any inoculations needed for travel to your project destination.

Where necessary, The Participant is responsible for showing proof of vaccinations, for example a certificate of Vaccination against Yellow Fever when travelling to Africa.

Insurance

The Participant accepts it is compulsory to obtain travel insurance to cover personal accident, medical and hospital expenses and repatriation. This must covers cancellation, curtailment, repatriation, legal expenses, medical and emergency travel, personal accident, personal liability, rescue and assistance, hijack and travel delay. The suggested minimum cover is £2,000,000 which should extend the planned length of your stay with GMP by two weeks. The Participant acknowledges that although GMP have said this is the minimal level, it still may not be adequate.

GMP accepts no responsibility for the loss of personal property, and insurance to cover loss of personal property by theft or accident is also recommended. The Participant is informed that full vehicle insurance is not necessarily available for all countries en route of projects, and that local vehicle insurance is of limited value.

The Participant agrees to indemnify GMP in respect of any accident, personal injury, loss of life or damage to property sustained by the Participant during the course of the project.

The Participant accepts that all projects involve an element of personal risk and are of a potentially hazardous nature and that neither GMP nor its agents can be held liable for any inconvenience, injury, damage to property or loss of life caused. The Participant accepts responsibility for all risks involved. The Participant is also advised to keep themselves informed of current Foreign Office travel advice in respect of countries to which they are travelling. If the Participant is married or has dependents, insurance to cover these responsibilities is strongly advised.

Passport, Visas and Travel Documents

Each participant must have an international passport, valid for at least six months after the end of the programme. Where a visa is necessary, GMP will provide the visa application forms, where necessary, a letter of invitation and advice on filling the forms in. Please note that all visas are entirely at the discretion of the embassy. For example, delays may be cause if you have not provided enough information. We are not responsible for the issue of visas. The Participant is responsible for ensuring that their passports, visas and any other travel documents are valid for the duration of the project.

Cancellations, Amendments and Refund Policy

The Participant’s contract with GMP will begin from the date that your deposit is received.

The Participant acknowledges that payment for the project is an intrinsic part of the project’s income and contributes to the overall costs of equipment, donation to project costs, staff administration etc and that GMP will have incurred the largest part of its costs before the actual date of departure.

Therefore, if the Participant cancels:

3 months or more before the departure date the deposit will be forfeit
2-3 months before the departure date 25% of project cost will be forfeit
1-2 months before the departure date 75% of project cost will be forfeit
Less than one month before the departure date (or a no show) 100% of the project cost will be forfeit.

A full refund of the deposit will be made if the Participant cancels up to 7 days from receipt of the deposit.

Any amendment of a booking must be put in writing and sent to the office. Alteration of a booking may incur a nominal transfer fee of no more than £50.

GMP requires the Participant to put a cancellation in writing. The client can then transfer the deposit to any other project pending availability within 12 months of the original booked tour departure date minus the £50 transfer fee.

In the unlikely event of GMP cancelling a project, all monies paid out will be refunded in full. This will be the full extent of GMP’s liability.

If the Participant joins after the designated arrival date or leaves before the specified departure date, no refund will be made. No refund will be made in respect of any part of the project that is not used or undertaken. Participants are advised to arrange travel insurance on booking in order to provide cover for these charges in the event of cancellation or delay.

When cancellations occur as a result of circumstances which are beyond the reasonable control of either party then the loss lies where it falls.

Participants Behaviour

Acceptance of a place by the participant binds the participant to the rules and procedures which GMP operates on its programmes, and the participant agrees to abide by the instructions of the country director/project staff representing GMP. any illegal act or inappropriate behaviour by an individual, that in the opinion of the programme staff is detrimental to the safety and welfare of the programme, may result in the participant being asked to withdraw from the programme, without the right to a refund.

GMP operates a strictly no drugs policy on overseas programmes. GMP retains the right to remove any participant from a programme if it deems that there is ‘sufficient suspicion’ that a participant has been involved with drugs during the programme. GMP does not have to prove such an act has occurred.

Complaints

With regard to any complaint or claim the Participant agrees

a) To ensure that at the earliest possible opportunity any perceived failure in the performance or improper performance of the contract whether by GMP or its suppliers is communicated to the project leader or supplier so that the concerns can be addressed

b) with regard to any perceived unresolved serious complaint to provide written details to the project leader

c) in the event of a claim for compensation the Participant agrees that any such claim must be detailed in writing and be received by GMP at its Head Office within 90 days of the project completion date, or within 30 days of the clients return to their home country, whichever is soonest.

Credit card payments

GMP accepts credit and debit card payments. However, due to the large fees charged by the credit card companies, we recommend that the Participant pays their final balance by cheque, online banking or debit card where no fees shall be levied by GMP. If the Participant elects to pay their final balance by credit card, a 3percent charge will be levied to cover the final cost incurred by GMP for the transaction.

Data protection

The participant agrees that GMP may hold and use personal data about the participant including sensitive personal data relating to the participant’s physical and mental health and that GMP may when appropriate share this information with medical advisers, insurers and persons involved in the operation of programmes. GMP will use such information in accordance with data protection law.

Limitation of liability

Nothing in these terms and conditions shall limit or exclude liability for death or personal injury as a result of GMP’s negligence or any other liability which cannot be lawfully limited or excluded.

Subject to the above clause, the participant agrees that GMP shall have no liability to you, other than expressly set out in these terms and conditions, for any loss or damage suffered or costs incurred, including travel or accommodation costs, and any indirect or consequential loss, arising under or in connection with your booking and participation in GMP ’s activities. You understand that your statutory rights shall not be affected.

Acceptance

The participant understands and accepts these terms and conditions and understands that they cannot be changed.

This agreement is governed by the law of England and any dispute relating to it will be subject to the exclusive jurisdiction of the English courts.
